These Terms of Use govern your use of the Custom Santa Video iPhone app. By using the app, and by accepting these terms during Sign in with Apple, you agree to them.
1. The service
You choose a Santa and provide details for a personalised Christmas video. The app can create a free cartoon video or a paid premium video, then lets you view, save and share the completed result. Generative AI is probabilistic: results can vary, may contain errors and are not guaranteed to meet a particular expectation.
2. Adults creating for children
The app is intended for adults creating a video for a child, family member or friend. Children must not create accounts or make purchases. If you provide information about a child, you confirm that you are their parent or guardian, or otherwise have permission to use that information for the video.
3. Details you provide
You keep your rights in the names, messages and other details you submit. You give us limited permission to store, transmit and process them only as needed to provide, secure and operate the service.
Provide only information you are entitled to share. Avoid sensitive information and use a child’s first name rather than their full name.
4. Acceptable use
You must not use Custom Santa Video to:
- submit another person’s information without permission;
- create or share unlawful, abusive, deceptive, harassing or infringing content;
- use a video to impersonate, defraud or mislead someone;
- probe, disrupt, reverse engineer or misuse the app or service; or
- circumvent safety, account, payment, credit or free-video limits.
Our systems and AI providers may refuse unsafe requests. If a paid video fails permanently, the video credit charged for that attempt is automatically returned.
5. Free and premium videos
The free cartoon video is a simpler product with limited personalisation. Availability and usage limits are shown in the app. Free videos and their associated data are deleted 30 days after creation, so save the finished video to Photos before then if you want to keep it.
Premium videos use a fuller script and animated Santa performance. Premium personalisation, scripts and temporary rendering files are kept through the Christmas support period and deleted by 31 January following the season in which the video was made. The finished premium MP4 and thumbnail remain in My Videos until you delete the video or your account.
6. Purchases
Custom Santa Video sells consumable video credits through Apple’s App Store. They are not subscriptions. Credits have no cash value, cannot be transferred and do not expire while the service and your account remain available.
Prices and taxes are shown by Apple before purchase. Apple processes payment. Sign in with Apple and acceptance of the current Terms of Use and Privacy Policy are required before buying credits.
7. Refunds
Apple controls App Store refunds. We cannot approve or pay an App Store refund ourselves. You can request one through Apple’s refund process.
If Apple grants a refund, the related video credits are reversed. Your balance may become negative if those credits were already used. You can object to future refund-consumption reporting through our support page. An objection does not prevent Apple from processing a refund or us from reversing refunded credits.
8. Generative AI and service providers
We use OpenAI to draft scripts, Google Gemini for free-video speech and premium title artwork, ElevenLabs for premium Santa voice tracks, Hedra to animate premium Santa performances, and Amazon Web Services to process, store and deliver videos. We send each provider only the information needed for its part of the service.
We do not use your details or finished videos to train our own AI models. Provider processing and limited safety-log retention are explained in our Privacy Policy.
9. Your videos and sharing
You may save and share a generated video for personal, lawful purposes. You are responsible for how you use and share it, including protecting a child’s privacy. We do not promise that a generated script or performance will be unique.
Custom Santa Video is an independent entertainment app. It is not affiliated with or endorsed by Apple or any other third party merely because their services are used to operate the app.
10. Availability and liability
We aim to keep the service available but do not promise uninterrupted or error-free access. We may change, suspend or discontinue characters, voices, music or service features where reasonably necessary.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights. Subject to that, Custom Santa Video is not responsible for indirect or unforeseeable losses, or losses caused by misuse of the app. Our total liability connected with a paid purchase will not exceed the amount you paid for the affected purchase.
11. Deleting videos or your account
You can delete individual videos from My Videos. You can permanently delete your account from Settings in the app after confirming your identity with Apple. Account deletion removes your account, remaining credits, saved video records and associated stored videos and thumbnails. It cannot be undone.
Signing out does not delete your account or server-side information.
12. Governing law and changes
These terms are governed by the law of England and Wales. If you are a consumer, you keep any mandatory protections and rights to bring a claim available where you live.
We may update these terms when the service or law changes. Material changes will use a new terms version and may require you to accept the updated terms before continuing.
